In most cases, you are able to keep your home. Even if you have equity in your home, you may be able to file Bankruptcy and protect it. If your mortgage is upside down (you owe the bank more than the house is worth), the Court WILL NOT require the sale of your home.
- Can I Keep my Car?
In most cases, you are able to keep your car. If your car is worth more than what you owe, there are Exemptions which can be applied to protect your car. Also, filing a Chapter 13 is often times the only way to save a car which about to be repossessed by the Bank.
- Will Bankruptcy Hurt My Credit Score?
The short answer is yes, but not being able to pay your bills also hurts your credit score. If you’re considering bankruptcy, you’re probably at the point where not filing for bankruptcy is more harmful to your credit than not.
- Can I Get A loan After I File For Bankruptcy?

Not at all. Bankruptcy is an individual filing and there is no requirement that your spouse file if you do.

The only way that your spouse's credit will be impacted is in relation to assets that the two of you share. For example, if you and your spouse’s names are on a mortgage and you file for bankruptcy, your spouse’s credit will be negatively affected for ONLY that loan. Any other loans or credit cards that your spouse holds will be unaffected.
